Waiver
(1) The Counci1 may, by a distributed two-thirds majority vote, re1ieve
a Member of an obligation
οη
account of exceptiona1 or emergency
circumstances, force majeure, constitutiona1 ob1igations or internationa1
obligations under the United Nations Charter for territories administered
under the trusteeship system.
(2) The Council,
ίη
granting a waiver to a Member, sha11 state explicitly
the terms and conditions
οη
which and the period for which the Member is
relieved of such obligation.
(3) Unless the Council decides otherwise, if a waiver brings about an
"increase
ίη
the annual export entitlement of the Member concerned the
annual quotas of a11 other exporting Members entitled to a basic quota
sha11 be adjusted pro rata so that the global annual quota remains
unaltered.
(4) The Council shall not consider a request for a waiver of quota
obligations solely
οη
the basis of the existence
ίη
the Member country
making the request,
ίη
one or more years, of an exportable production
ίη
excess of its permitted exports or which is the consequence of the Member
having failed to comply with the provisions of Articles 50 and 51.
(5) The Council may make rules concerning the procedures for the granting
οί
waivers and the criteria for so doing.
