ΕΠΙΣΗΜΟΣ ΕΦΗΜΕΡjΣ ΤΗΣ 26ης ΝΟΕΜβΡIΟΥ

προσ'Πάθειαν πρός έπίτευξιν συμφωνίας μετά
της άρμοδίας άρχης του έτέρου Συμ<!lαλλομέ­
ναJ Κράτους πρός τόν σκοπόν άποφυγης φορο­
λογίας μη συναδούσης πρός την παρουσαν Σ ύμ­
t!ιασιν.
2.
Έάν επιτευχθΏ τοιαύτη συμφωνία ή άρμο­
δία αρχη του οίκείου Σ υμ<!lαλλομένου Κράτους,
κατα τό αναγκαίον μέτρον θά έπιστρέΨη τό
έπιπλέον πληρωθέν ποσόν, θά χορηγήση φορο­
λογικα προνόμια η θα είσπράξη φόρον.
3.
Αί άρμόδιαι άρχαι των Συμ<!lαλλομένων
Κρατων Θα κατα<ΚΧλλουν προσπάθειαν επιλύ­
σεως, δι' άμοι(;αίας συμφωνίας, οίωνδήποτε:
δυσκολιων προκυπτουσων εκ της έφαρμογης
της παρούσης Συμ<!lάσεως. Δύναντάι, ώσαύτως,
νcX συζητΟΟν μεταξυ των δια την δυνατότητα
άΠO<J?υγης της διπλης φορολογίας είς περιπτώ­
σεις αίτινες δέν προνοουνται εν τη παρούση
Συμ<!lάσει.

'Έναρξις' Ι σχύος της Συμ<!lασεως
1.
τα Συμ~αλλόμενα Κράτη θα γνωστοποιοΟν
είς άλληλα μέσ~ της διπλωματικης δδοσ την
εκπλήρωσιν των αναγκαίων διατυπώσεων δια
την εναρξιν της ίσχύος της .
παρούσης Συμ~ά­
σεως.
2.
~H παροϋσα Σ ύμ~ασις τίθεται εν ίσχόι με­
τα παρέλευσιν

20
Τερματισμός της Συμ<!lάσεως
Ή παρουσα Σ ύμ<!lασις θα παραμείνη έν ίσχύι
μέχρις στου εν των Συμ~αλλoμένων Κρατων
καταγγείλη ταύτην. <Έκαστον Συμ<!lαλλόμεvoν
Κράτος, δ6ναται σπως, μετα πάροδον πέντε
ετων άπό της ή μερcψηνίας ένάρξεως ίσχύος
της Συμ~άσεως, καταγγείλη ταύτην άφου έπι­
δώση γραπτην είδοποίησιν περι τερματισμοϋ
μέσ~ της διπλωματικης δδοϋ ούχι αργότερον
των εξ μηνων πρό του τέλους οίουδήποτε ήμε­
ρολογιακου ετους. Έν τοιαύτη περιπτώσει ή
Σ ύμ~ασις παύει ίσχύουσα δσον άφo~ είς φό~
ρους και έπι~αρύνσεις

August 1, 1975, towards the develop–
ment and deepening

economic, industri'a:1, scientific, technical and cultural cooperation, and with
the aim of avoiding double taxation, have agreed

Article 1
Persόns
to which the Convention shaH apply:
1. This Convention s'h'all 'apply to persons who
for the purposes of t'axation are deemed

residents of one or both of the Contracting States.
2. For the purposes

this Convention the term
"resident of a Contracting State" means a person
who, under the laws of that State, is liable
ιο

xation therein by reason ofhis domicile, residence,
p]ace of effective management or any other cri–
terion of a similar nature.
3. The term "resident ofboth Contracting
States" means a person deemed to be a resident
of each of the Contracting States for tax purposes
therein during the same period

4. Where by reason of the

graphs 2 and 3 an individual is deemed to be a
residcnt of each of the Contracting States, his
status shall be determined
