:—Where there were different charges in the same information based on the same facts the case is placed under the
heading of the most serious charge in coses of acquittal and under the heading of the most serious charge on which there
was a conviction in cases of conviction.
W h e r e there were different charges in the same information based on different facts each charge is placed under its
proper heading.
Where a person was prosecuted for one offence and convicted of another (e.g., committed for homicide with
premeditation and convicted of homicide without premeditation) the case appears only under the offence of which he was
convicted.
(1) Murder means homicide punishable by death and includes cases of being an accomplice in the commission of that
offence.
